Is a marriage in France legal in the US?

Yes! A marriage legally performed in France is recognized in the US. However, it must comply with French civil requirements first.

The reality: Why most couples choose a symbolic ceremony

While it is possible to have a legal marriage in France as an American, it can be complicated. French law requires at least one member of the couple to have resided in France for a minimum of 30 days immediately before the civil ceremony in the commune (town) where the wedding will take place.

Because of this, most American couples opt for a civil ceremony in the US first, then enjoy a symbolic celebration in France; allowing them to focus fully on the magic of the day without paperwork stress.

What are the legal requirements?

If you still wish to pursue a legal marriage in France, here’s what’s typically required:

  • Proof of residency in France for at least 30 days before the wedding (usually in the town where you plan to marry).
  • Valid passports for both parties.
  • Long-form birth certificates, issued within the past three months and translated into French by a sworn translator.
  • Affidavit of law (certificat de capacité matrimoniale) confirming your eligibility to marry, obtained from the US embassy or consulate.
  • Proof of address (utility bills, rental contract, etc.).
  • Publication of marriage banns at the local mairie (town hall), usually posted for 10 days.
  • Additional documents if divorced or widowed.

Every commune may have slightly different requirements, so it’s essential to check directly with the local mairie.

Do you need to register your marriage in the US?

If your marriage is legally performed in France, it is generally recognized automatically in the US. You may, however, choose to record your French marriage certificate with US authorities or your state, especially for administrative reasons (name change, taxes, etc.).
